“Swerving all over” Arrest

A 35-year-old Maryland man who originally refused to pull over received no bond after numerous bad decisions.

On December 9th at approximately 12:31 a.m. First Sergeant M.R. Flick responded to I-95 Southbound near mile marker 143 for a drunk driver complaint. The caller advised a vehicle was “swerving all over” the road. It was not hard for First Sergeant Flick to locate the vehicle due to it actively serving in front of him. When the suspect vehicle swerved into another lane, nearly striking another vehicle, First Sergeant Flick turned on his emergency equipment in an attempt to conduct a traffic stop.

While First Sergeant Flick wanted to conduct a traffic stop, the driver did not and continued on without slowing down. The vehicle continued despite both Sergeant E.E. West and a Virginia State Trooper joining in on the attempt to conduct a traffic stop. Finally, the driver realized he wasn’t going to beat Stafford County and pulled over around mile marker 139.

The driver, identified as Cesar Agustin Matildes, had extreme signs of being intoxicated. When asked how much he had to drink, Agustin advised he had “a little bit”. His definition of “a little bit” was discovered to be approximately ten beers. A bit more than “a little bit”. During a search incident to arrest, suspected controlled substances were also located.

Agustin was charged with driving under the influence with a blood alcohol content above .2, reckless driving, misdemeanor eluding, and possession of controlled substances. He was held at Rappahannock Regional Jail pending his ability to participate in a bond hearing.
Drive sober or get pulled over.
