Double Brandishing Offense

A 30-year-old Stafford man decided to flash his firearm in an intoxicated state after being unable to purchase more booze early Sunday morning.

On July 21st at approximately 12:49 a.m. deputies responded to the area of 7-Eleven, located at 2998 Richmond Highway, for a disturbance. The caller advised a driver was clearly intoxicated and brandished a firearm within the business. With a description of the vehicle, Deputy X.D. Bates located the vehicle traveling on Garrisonville Road and a high-risk traffic stop was conducted in the area of Wells Fargo, located at 131 Garrisonville Road.

While attempting to detain both the driver and passenger, the driver would refuse commands, start stripping, and make derogatory comments towards deputies. Both parties were eventually detained. Both had signs of intoxication. Within the vehicle two firearms, one of which was concealed, and a nearly completely consumed bottle of tequila were located. As the DUI investigation began, additional deputies returned to 7-Eleven to determine how this all started.

Staff advised the driver, who “you could tell,” was intoxicated, entered the business in an attempt to purchase alcohol. Due to the late hour, staff informed him they could not sell him the alcohol. In response, the suspect began “swinging” his firearm around before leaving the business.

While gathering the facts at 7-Eleven, another victim came forward advising that he too had a firearm brandished. This victim advised while conversing with the same suspect in the parking lot, the suspect would brandish his firearm again.

The suspect would continue his aggressive behavior throughout the investigation and in front of the magistrate, advising he would “raise all Hell.” His plans would have to wait for he was charged with driving under the influence, refusal, failure to wear a seatbelt, obstruction of justice, and two counts of brandishing a firearm. He was held without bond at Rappahannock Regional Jail. The passenger was charged with carrying a concealed weapon and failure to wear a seatbelt. He was held at Rappahannock Regional Jail until sober.
