Drink and Driving with a Toddler

A 36-year-old Stafford woman who crashed her vehicle into a ditch with her child improperly secured was held without bond Wednesday afternoon.

On December 13th 7:33 p.m. Deputy C.C. Crossett responded to Clore Drive for a single vehicle auto accident. The caller advised a vehicle had driven into a ditch, and the driver was begging people not to call the police.

When Deputy Crossett arrived, the vehicle was no longer in the ditch. The driver, later identified as Danielle Penberthy, called a tow truck to remove her vehicle from the ditch and attempted to leave. Luckily, nearby concerned citizens took her keys to prevent her from leaving. Within the vehicle was not only an open case of beer, but an improperly secured child seat. Penberthy advised she consumed “two beers” but was unsure when due to her level of intoxication. Her and the child within the vehicle at the time of the crash were not harmed.

Penberthy was eventually charged with driving under the influence second offense within five years with a blood alcohol content between .15 and .2 with a child present, felony child neglect, second offense refusal, reckless driving, and transporting a child with improper child restraints. She was held at Rappahannock Regional Jail without bond while the child was turned over to a responsible adult.
