The Stafford County Sheriff’s Office is reporting that Spurgeon Day, age 41, of Garrisonville Road in Stafford, Virginia was charged with videotaping a patron at a day spa while she was undressed during a scheduled massage. Day is a former employee at the spa where the incident occurred. The suspect has been charged with a Class 1 misdemeanor.

An affidavit was filed with the magistrate on April 5, 2016 to search the premises of the suspect after his phone was discovered to have a videotape of the patron made on March 30, 2016. The Sheriff’s Office has seized numerous electronic devices, in addition to the phone, as evidence in the case. Computer forensics is being conducted on all devices.

At this time the Sheriff’s Office does not believe the place of business had any prior knowledge of this criminal activity being conducted in the establishment. Currently, the Commonwealth’s Attorney’s Office is reviewing the facts of the case and the criminal investigation is ongoing.
